 Please read this Commission Policy carefully before using the https://www.velfineart.com website ("Vicente Enriquez Landin Fine Art", the "Service") operated by Vicente Enriquez Landin (the "Artist"), who represents VEL FINE ART, LLC. This document is specially designed for commissioned artworks, which are subject to certain different policies than the ones applied for sales items.

Introduction

 Welcome to Vicente Enriquez Landin Fine Art! Vicente Enriquez Landin is the artist behind the creations you’ll find on this site. As the founder, owner, and manager of VEL FINE ART, LLC, he is committed to providing you with exceptional service and ensuring your satisfaction with every purchase. This Commission Policy outlines the terms and conditions regarding the process, service, products, expectations, and responsibilities for commissioned artworks. This policy ensures clarity and transparency for both parties, facilitating a seamless and mutually advantageous collaboration between you and the Artist. By using this website, which is operated by the Artist and powered by Squarespace, you agree to the terms described below.

Availability

- The Artist accepts commissions on an occasional basis, depending on his current workload and the specific requirements of each project. Please note that he may not always be able to take on new commissions. Availability is subject to change, and he reserves the right to decline any commission requests at his discretion.

- When the Artist is unavailable for commissions, a notice will be shown in the Commissions page of this website.

Commission Requests

- Please submit all commission requests through the online Commission Form on this website.

- Provide the Artist with detailed information about your commission, including subject matter, size, medium, and any specific requirements or preferences.

- Once your request is received, the Artist will review it and provide you with a quote and estimated timeline for completion. All details will be discussed through a personal consultation.

Orders

- There is no obligation to order after a personal consultation.

- All commissions are subject to acceptance. The Artist reserves the right to refuse any order at his discretion. 

- The Artist only accepts commissions of his original art, which means that he only creates pieces in his own style and vision, so that they match his body of work’s themes and aesthetics. As an artist, he needs total freedom and control to craft authentic artworks.

- Projects that denigrate, show forms of mistreatment or violence to any person or animal, or asks for immoral or prohibited content by law are not accepted.

- Minors interested in the Artist’s services must be represented directly by their parents or legal guardians.

Pricing

- The commission prices vary depending on the complexity, size, and medium of the artwork. Complex and larger pieces require more time, thereby increasing the cost of the production process.

- The Artist will provide you with a detailed price quote based on the information you provide.

Completion Time

- Timelines vary for each project, depending on size, complexity, and the schedule on the Artist’s waiting list. Please be aware that the Artist works on a first come first serve basis. 

- The estimated completion time will be communicated upon receipt of the deposit required for the personal consultation.

- The Artist honors deadlines, but he cannot fully guarantee them. Delays may occur due to unforeseen circumstances, if that’s the case any changes in schedule will be communicated. 

- The Artist will contact the client before start working on the artwork, to confirm that he is beginning at that particular time. It usually takes 2 to 4 weeks to create a piece once the artistic process has begun (this may vary depending on the size, complexity and media), but the Artist will always be willing to meet any personal deadlines.

Payment

- Payments are accepted in USD. 

- A non-refundable flat fee of $30 is required to book a personal online consultation with the Artist for up to 30 minutes to discuss the project details. More time may incur extra charge. If you decide to proceed with the commission after the consultation, this fee will be deducted from the final balance. However, if you choose not to proceed with the commission, the fee will not be refunded, as it compensates for the time the Artist spent attending to you during the consultation.

- A 50% deposit of the total price is required before the Artist begins working on your commission. It will secure your spot on the Artist’s waiting list.

- Payments can be made through electronic money transfer services such as Online Direct Deposit, Zelle, Cash App, Stripe, or PayPal. Cash is also welcome if local. An invoice will be sent by email addressing the 50% deposit.

- Final payment plus applicable sales tax are due upon completion and approval of the artwork.

Changes and Revisions

 Client satisfaction is paramount, yet there are boundaries to the changes that can be made at the client's request. The Artist will only undertake revisions that align with his established style and do not conflict with his mission or vision. This approach ensures adherence to the business's purpose and brand identity. Based on that, the Artist gives you the chance to share your feedback and thus guarantee your satisfaction during the artistic process:

- Sketching Phase: According to the subject, you may request reasonable changes during the sketching phase. One round of revisions is provided free of charge. Subsequent revisions will incur additional costs.

- Production Phase: Once the Artist begins working on the original piece, you may request minor changes during the progress of the artwork. One round of revisions is provided free of charge. Subsequent revisions will incur additional costs. Major changes that significantly alter the original concept may result in considerable extra charges; in these instances, you will be notified of an updated completion timeline, as substantial modifications can extend the process accordingly.

- Final Approval: Review the near-final artwork, provide any closing remarks, and confirm satisfaction before the piece is finalized. Only final minor adjustments may be requested if necessary. One round of revisions is provided free of charge. Subsequent revisions will incur additional costs.

- After Approval: Once you approve the final picture, no further modifications will be made unless agreed upon and may involve additional charges.

Packaging and Shipping

- Artwork will be carefully packaged with high standards and shipped to your designated address using a reliable carrier service.

Copyright and Reproduction

- Upon full payment, you shall own the commissioned artwork, but not the copyright to the piece. All rights remain reserved by the Artist.

- The Artist maintains complete copyright ownership over all generated artwork, encompassing mock-ups, sketches, and prints, associated with any commissions. This grants the ability to use them for promotional and commercial purposes unless otherwise agreed upon. It means that the Artist can produce prints, calendars, posts, etc., featuring the commissioned artwork. 

- When artworks are commissioned, the Artist reserves the right to showcase them on his website and social media. If you prefer your commissioned artwork not to be displayed online you should inform the Artist before the commencement of work.

- Reproduction or distribution of the artwork without the Artist’s permission is strictly prohibited.

- If you are interested in using the reproduction rights of an artwork purchased by you, an additional fee applies. By purchasing an artwork, you are granted a non-exclusive license for personal use only. Commercial use requires additional licensing. The pricing details for this are not listed on this website; feel free to reach out for more information.

Quality Guarantee

- The Artist proudly guarantees the highest quality and excellence in the execution of his artworks. All art materials used are of professional grade and are intended to last for generations, if proper conservation measures are taken. The aesthetics of the artworks involve a great level of mastery, detail and artistic sensibility. In the rare event that you are not satisfied with the final piece due to quality issues, the Artist will work to rectify the concerns within reason. Throughout his career, the Artist has never had any problems related to the quality of his work.

Future Responsibility

- The Artist is not responsible for changes in the artwork due to climate, humidity, moisture, molds, infestation, stains, warping, shrinkage, expansion, corrosion or any other events that may occur to artwork(s) over time.

Order Cancellation

- Either party may cancel a commission with written notice.

- Should the Artist cancel your commission due to unforeseen circumstances before finishing your artwork, he will issue a full refund as compensation for the trust you placed in his services.

- To initiate a cancellation by your part, you must contact the artist via email at support@velfineart.com with the subject line “Cancellation Request”. 

- Cancellation Within 72 Hours After Ordering: You have the chance to cancel your commission within 72 hours after placing your order. In such cases, please notify the Artist as soon as possible, and the initial deposit will be refunded in full. Upon cancellation you will lose your place on the Artist’s waiting list.

- Refund Method and Processing Time: Refund will be made by the same method used to receive payment. It will be processed by the Artist within 72 hours from the date of the cancellation request. The processing time for refunds may vary depending on the payment provider. Please allow a few business days for the refund to be processed after the Artist initiates it.

- Cancellation After 72 Hours of Booking and Before Work Commencement: Depending on his schedule, workload, and time preparing the conditions for your project, the Artist may take some time after you place your order and before he starts creating your piece. If you need to cancel your booking after 72 hours of placing your order and before the work begins, you will be charged 50% of your initial deposit (25% of the total price). This will offset the costs associated with administration, emails, mock-ups, purchase of materials and time spent preparing the project up to that point. The other half of the deposit will be refunded.

- Confirmation Before Commencing Work: The Artist will contact you before starting your artwork to ensure you are comfortable with the specified commencement time.

- Cancellation After Work Commencement: If you cancel after the Artist has begun creating your work, the deposit is non-refundable. It will be retained as loss of business to cover all the effort, time and resources employed (please be aware of this policy).

- Prompt Notification for Schedule Planning: If you are unable to proceed with the booked artwork for any reason, please inform the Artist promptly. This allows the Artist to manage his schedule efficiently and potentially accommodate other clients.

- Custom-Made Artwork Refund Policy: Commissioned artwork is custom-made, and as such, refunds will not be granted for completed work once you have approved the final piece (please consider this when confirming your approval).

- Cancellation for Short-Term Commissions: Should the Artist initiate an urgent commissioned artwork within the 72-hour cancellation period, and you, having been informed and previously consented to the prompt commencement of work, opt to cancel the order during this timeframe, it will be categorized as “Cancellation After Work Commencement”. In such instances, the deposit will not be refunded to account for the time, materials, and effort already invested.

Dispute Resolution

- Any disputes arising from the use of the Artist’s services will be resolved through negotiation or, if necessary, through legal proceedings in accordance with the laws of the State of Florida. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located within the State of Florida.

- Open and timely communication is crucial throughout the process. Both parties agree to respond promptly to messages and requests for feedback.

Changes to Policies

- The Artist reserves the right to amend his policy at any time. Users are encouraged to review it periodically for updates.

By proceeding with the commission, both parties acknowledge and accept this Commission Policy.
